These Terms of Sale ("Terms") govern the purchase of digital products and templates (collectively, "Products") from desyner ("we", "us", "our") through our website desyner.store (the "Store"). By placing an order, you agree to be bound by these Terms.
desyner is operated by Marie Hélène BAYO, Sole Proprietorship, located at 26 Rue du Port à Belleau, Briare, 45250, France.
1. Contract Formation
Your order constitutes an offer to purchase Products from us. We reserve the right to accept or reject your order at our discretion. A contract is formed only when we send you an order confirmation email. Until that time, we may cancel or modify your order.
2. Product Descriptions and Pricing
We make every effort to ensure that product descriptions, previews, and prices are accurate. However, we do not warrant that product descriptions or other content on the Store are error-free. If a Product is listed at an incorrect price, we reserve the right to cancel or refuse any orders placed at that price.
All prices are listed in [USD] and are exclusive of applicable taxes, which will be calculated at checkout based on your location.
3. Digital Products — Nature of Transaction
All Products sold on desyner.store are digital templates and digital content. There are no physical goods involved in any transaction. You are purchasing a license to use the digital files, not the files themselves. Delivery is electronic and instantaneous upon successful payment confirmation.
4. Payment
Payment must be made in full at the time of order. We accept payment through the payment methods made available at checkout. All payments are processed securely by our third-party payment processors.
5. Delivery
Upon successful payment, you will receive an email containing download links or access instructions for your purchased Products. Delivery is considered complete at the time the download links are sent to your provided email address. You are responsible for ensuring that your email address is correct and that you can receive our emails.
6. Right of Withdrawal (EU/UK Consumers)
If you are a consumer located in the EU, EEA, or UK, you have the right to withdraw from a purchase within 14 days of the contract conclusion without giving any reason.
However, as our Products are digital content delivered immediately, you expressly agree to the following:
- You consent to the immediate delivery of the digital content before the 14-day withdrawal period ends.
- You acknowledge that by giving this consent, you waive your right of withdrawal.
At checkout, you will be required to check a box confirming your consent to immediate delivery and your understanding that you are waiving your 14-day right of withdrawal. If you do not provide this consent, we will not deliver the Products until the 14-day withdrawal period has expired.
7. Refund Policy
Refunds are governed by our Return and Refund Policy (https://desyner.store/policies/refund-policy). Please refer to that policy for details on refund eligibility and the process for requesting a refund.
8. Taxes
You are responsible for paying any applicable taxes, including VAT, sales tax, or other transactional taxes, as required by your local tax laws. Taxes will be calculated and displayed at checkout.
9. License Grant
When you purchase a Product, you are granted a non-exclusive, non-transferable, worldwide license to use the templates for personal and commercial purposes, subject to the restrictions set forth in our Terms of Service (https://desyner.store/policies/terms-of-service).
10. Prohibited Conduct
You may not:
- Resell, redistribute, or sublicense the Products (in original or modified form) as standalone products.
- Claim ownership of the Products or assert that you created them.
- Use the Products for any unlawful or harmful purpose.
- Share download links with unauthorized third parties.
11. Warranties and Disclaimers
All Products are provided "as is" and "as available" without any warranties of any kind. We do not warrant that the Products will meet your specific requirements or that they will be compatible with all software versions. We recommend reviewing product previews before purchase.
12. Limitation of Liability
To the fullest extent permitted by law, our total liability to you for any claim arising from these Terms or your purchase shall not exceed the total amount paid by you for the Products. We shall not be liable for any indirect, incidental, special, or consequential damages.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of France.
For consumers located in the EU, EEA, or UK, you may also have the right to bring proceedings in your country of residence. Alternative dispute resolution is available through the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
